ZONING BOARD OF REVIEW

NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN THAT THE JAMESTOWN ZONING BOARD OF REVIEW WILL HOLD A PUBLIC HEARING ON NOVEMBER 28, 2006, AT THE JAMESTOWN LIBRARY, 26 NORTH ROAD, JAMESTOWN, RHODE ISLAND AT 7:00 P.M. UPON THE FOLLOWING:

Application of Peter and Joseph DiBiase, whose property is located at Beach Ave. and Ferry St., and further identified as Tax Assessor's Plat 5, Lots 52 & 53 for a special use permit from Article 3, Section 82-314 to construct a single-family two-bedroom home within the "High Groundwater Table and Impervious Layer Overlay District". Said property is located in a R40 zone and contains 14,400 sq. ft.

Application of Lynne & Armand Musumeci, whose property is located at 260 Capstan St., and further identified as Tax Assessor's Plat 3, Lot 97 for a variance from Article 82, Section 302 Table 3-2 (District Dimensional Regulations) to construct additions to an existing dwelling which will be 25'3" from the front (southerly) lot line, 30' being the requirement, and 13'11" from the corner (easterly) lot line, 20' being the requirement. Said property is located in a R40 zone (R20 setbacks), and contains 7,098 sq. ft.

Application of Daniel E. Lilly, Jr. & Jean T. Lilly as Trustees of the Daniel E. Lilly, Jr. and Jean T. Lilly Joint Living Trust, whose property is located at 132 Beach Ave., and further identified as Tax Assessor's Plat 5, Lot 205 for a variance from Article 3, Section 82-308 (Setback from Freshwater Wetlands) and a special use permit from 82-314 (High Groundwater Table and Impervious Layer Overlay District)

to raze an existing dwelling and replace this structure with a new dwelling, and to replace the existing septic system with a new advanced treatment septic system which will be 130' from a wetland wherein 150' is required. Said property is located in a R40 zone and contains 21,600 sq. ft.

NOTICE IS HEREBY GIVEN THAT THERE WILL BE A PUBLIC HEARING BY AND BEFORE THE TOWN COUNCIL OF THE TOWN OF JAMESTOWN ON THE 13TH OF NOVEMBER 2006 AT 7:00 P.M. AT THE JAMESTOWN PHILOMENIAN LIBRARY CONFERENCE ROOM, 26 NORTH ROAD, JAMESTOWN, RI PURSUANT TO 5-24-1 OF THE GENERAL LAWS OF RHODE ISLAND, 1956, AND AS AMENDED, UPON THE FOLLOWING APPLICATION: RENEWALS: Drake Petroleum Company, Inc. dba: Jamestown Xtra Mart 35 Narragansett Avenue Plat 9 Lot 246

Cumberland Farms, Inc. dba: Cumberland Farms Store #1108 41 North Main Road

Plat 8 Lot 626 APPLICATION OF DRAKE PETROLEUM COMPANY, INC., Inc. dba: Jamestown Xtra Mart, for renewal of additional operational hours between 2:00 AM and 6:00 AM for the said establishment, holder of a Victualing License issued by the Town of Jamestown. If granted, this will allow this establishment to continue to be open 24 hours per day.

APPLICATION OF CUMBERLAND FARMS, INC., dba: Cumberland Farms Store #1108, for renewal of additional operational hours between 5:00 AM and 6:00 AM for said establishment, holder of a Victualing License issued by the Town of Jamestown. If granted, this will allow this establishment to continue to be open from 5:00 AM to 2:00 AM daily (RIGL 5-24-1 allows this establishment to be open until 2:00 AM).

All interested persons are notified to be present at said hearing to be heard for or against the granting of said applications. All interested persons at said hearing shall be given an opportunity to be heard on said application.

The above applications will be in order for hearing at a meeting of said Licensing Board on MONDAY, NOVEMBER 13, 2006 at 7:00 pm. at the Jamestown Philomenian Library, 26 North Road, in said Jamestown, at which time and place all remonstrates may make their objections against granting these licenses.
