NOTICE OF PUBLIC HEARING TOWN OF JAMESTOWN
The following is intended to amend Section 22 of the Jamestown Code of Ordinance. A public hearing to solicit public input is scheduled on Monday, December 10, 2007 at 7:00 p.m. in the council chambers of the Jamestown Town Hall, 93 Narragansett Avenue, Jamestown.
AN ORDINANCE AMENDING CHAPTER 22
OF THE CODE OF ORDINANCES OF THE
TOWN OF JAMESTOWN
The Town of Jamestown is considering a recent proposal by the Jamestown Tree Preservation and Protection Committee to amend the following sections of the Town's Tree Preservation and Protection Ordinance.
THE TOWN OF JAMESTOWN HEREBY ORDAINS AS FOLLOWS: Sec. 22-91. Appeals and adjustments.
Any adjustment of the standards required by this article or an appeal of a decision of the tree warden shall be heard by the tree warden Tree Preservation and Protection Committee. All appeals shall be in writing to the tree warden Tree Preservation and Protection Committee. The tree warden Tree Preservation and Protection Committee shall hold a public hearing at some suitable time and place after giving notice to all persons known to be interested therein and posting the hearing in the town hall and also at the location the hearing is to be held seven days (including the day of the hearing) prior to the hearing. Within three days after the hearing, the tree warden Tree Preservation and Protection Committee shall render the decision granting or denying the appeal. Any appeal of a decision of the Tree Preservation and Protection Committee shall be heard by the Town Council.
Sec. 22-116. Tree committee. k. Assist the tree warden in issuing permits and shall hear appeals of decisions of the Tree Warden.
Sec. 22-143. Clearance of public rights-of-way. (b) Planting of trees along highways, rights-of-way, and on Town land will take into consideration General Tree Planting Rules and Guidelines and Rules and Regulations for Subdivisions of Land, Town of Jamestown, R.I. A notice to any abutter to a planting of a new tree or trees, but not replacement of trees, that potentially would obstruct a property owner's view of Narragansett Bay shall be sent not less than thirty (30) days in advance of the planting to the address on record in the Tax Assessor's officeand shall advise the abutter of the appeal process outlined in 22-143
This amendment shall take effect immediately upon passage.
Copies of the proposed amendment are available for review at the Jamestown Town Hall, 93 Narragansett Avenue during normal business hours. The proposed Ordinance amendment may be altered or amended prior to the close of the public hearing without further advertising, as a result of further study or because of the views expressed at the public hearing. Any alteration or amendment must be presented for comment in the course of the hearing.
