NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN THAT THE JAMESTOWN ZONING BOARD OF REVIEW WILL HOLD A PUBLIC HEARING JUNE 22, 2010, AT THE JAMESTOWN TOWN HALL, 93 NARRAGANSETT AVENUE, JAMESTOWN, RHODE ISLAND AT 7:00 P.M. UPON THE FOLLOWING:

Application of Mark Smith (Jacqueline Haberland, Trustee owner), whose property is located at Starboard Ave., Buoy & Ship Sts., and further identified as Tax Assessor’s Plat 15, Lot 84, for a special use permit as required by Jamestown Ordinance 82-314C. (High ground water table and impervious overlay district) to allow the installation of a new onsite wastewater treatment system (OWTS) and the construction of a single-family, 3 bedroom house on the site as approved under development plan review by the Jamestown Planning Commission. Said property is located in a R40 zone and contains 21,600 sq. ft.

East Coast Landscaping and Construction, Inc. has filed a petition in equity in said office representing that 10-12 High Street, LLC is indebted to it in the sum of $74,703.80 besides interest, according to an account filed with said petition, for materials furnished, and work and labor performed in the construction, erection and reparation of a certain building, belonging to 10-12 High Street, LLC situated in the Town of Jamestown, Rhode Island upon lot of land owned by the said 10-12 High Street, LLC in fee simple, bounded and described as follows, to wit:

claiming a lien for said amount, with interest and costs, and praying that said lien may be enforced against said land and building and against the right, title and interest that said 10-12 High Street, LLC as the owner thereof, had in and to the same at the time said petitioner’s lien accrued thereon, and attached thereto, and that the same may be sold to satisfy said claim of the petitioner and all other accounts and demands for which the same is pledged and liable by Title 34, Chapter 28 of the General Laws, of 1956 and the amendments thereto.

Notice is herby given to all persons having a lien by virtue of said title and chapter of the General Laws, and the amendments thereto, or a mortgage, or an attachment, or any other claim on all or any part of said property, respond, it they shall see fit, before our Superior Court, at Newport within the County of Newport, on the 9th day of July 2010 and make out their demands against the same.
