Swain children will not inherit Tyre estate
David Swain’s adult children will not be allowed to inherit any money from their stepmother’s estate, the state Supreme Court decided last week.
A divided court ruled 3-2 prohibiting Jeremy and Jennifer Swain from inheriting the $5,572 even though they were named benefi ciaries by Swain’s former wife, Shelley Tyre. The majority ruled that the Rhode Island Slayer’s Act excludes the stepchildren from collecting what remains of the estate.
Tyre drowned while scuba diving on vacation in 1999 in the British Virgin Islands. Swain was found guilty by a jury and sentenced to 25 years, but an appeals court overturned the decision in September 2011.
